Prosecutors say suspect’s child shot by same gun days after deadly shooting

HOUSTON – Charges have been filed against a man accused of fatally shooting another man in front of his 10-year-old daughter at Dave and Buster’s on April 4, according to the Houston Police Department.

Nicholas Dwayne Thomas, 23, has been arrested and charged with capital murder for the death of 37-year-old Miguel Vasquez. Houston police said the shooting was reported at a Dave and Buster’s located at 7620 Katy Freeway.

“To know that we finally have somebody in custody, it’s like a weight off your chest,” Miguel’s niece said.

Police said Vasquez was with his family for several hours at the event place before leaving out with his daughter, police said. He was shot by Thomas during a robbery and his daughter witness the entire incident, police said.

Vasquez ran back inside the building for help and was transferred to Memorial Hermann Hospital where he was pronounced dead, police said.

On Thursday morning in court, prosecutors said the firearm from April 4th’s shooting matched the same shell casings in the accidental shooting of the suspect’s 3-year-old son on April 8. The second shooting is being investigated.

Thomas’s bond was set at $150,000 plus conditions.

Vasquez family speaks after arrest made

The family of Miguel Vasquez said they are grateful the police have finally made an arrest in the case. Miguel’s wife said an arrest does bring some sense of relief knowing a suspect isn’t still out on the streets.

“We felt relieved that they finally caught somebody because, to be honest, I thought they weren’t ever going to find somebody,” Miguel’s niece added.

Loved one said despite the time that has passed, the entire family, including his wife and two young children, still grieve each and every day.

“There are no words to describe how he destroyed our family,” Miguel’s niece explained.

While they’re thankful an arrest has been made, the family now wants justice in the case.

“How could you live with yourself for two months knowing you did that in front of somebody’s daughter,” Miguel’s niece said.

A GoFundMe has also been set up for Vasquez’s wife and two children.
