HOUSTON – The Turkey Leg Hut, the popular Houston restaurant that has been embroiled in a battle of accusations with neighboring residents about its outside smokers, has won a motion that temporarily lifts the temporary restraining order that restricted its use of the smokers. Last week, a judge handed down a 14-day restraining order that barred the Turkey Leg Hut from using its outside smokers from 8 p.m. to 6 a.m. each day. The Turkey Leg Hut’s attorney John Zavitsanos filed a motion Monday night seeking to dissolve the emergency temporary restraining order and increase the $500 bond securing the order, as requested in an emergency injunction filed by a small group of residential neighbors. The Turkey Leg Hut took issue with the timing, right before Thanksgiving and just two weeks before the fully noticed hearing. The Turkey Leg Hut will comply with the hours stated in the emergency restraining order after the holiday weekend; restricting smoking times on December 24, 2019 between the hours of 8 pm and 6 am.

Turkey Leg Hut received food safety citations in July 2018 and August 2019. On Wednesday, six neighbors slapped the Turkey Leg Hut with a lawsuit, forcing the restaurant to stop using outside smokers from 8 p.m. to 6 p.m. for 14 days. Neighbors said both requests have been repeatedly denied, leaving them no option but to file the temporary injunction limiting the hours the Turkey Leg Hut can smoke meat outdoors. The temporary order will expire on Dec. 4., however, neighbors are seeking more long-terms restrictions on outdoor food preparations and smoking for the Turkey Leg Hut.

The Turkey Leg Hut will not be able use its outside smokers from 8 p.m. to 6 a.m. daily for 14 days. Turkey Leg Hut owners Nakia and Lyndell Price declined to be interviewed for this story, but did issue a statement defending their restaurant. “…We will continue to rigorously defend all allegations made against us as we always work hard to have a safe and healthy environment for our community and patrons.”Cris Felman, who the attorney for the neighbors, said all of the outdoor cooking activities at Turkey Leg Hut are illegal. She says he has asthma and that the thick smoke from the smokers make it hard for her breathe.
