HOUSTON – We are learning new details in a deadly shooting that a prosecutor says started over a noise compliant.

Omar Marzouk 38, has been charged with murder in the death of Jimmy Arevalo. The 32-year-old was a contract worker who was power washing kitchen equipment outside a Houston convenience store.

During court, it was revealed that Omar Marzouk reportedly tried selling several items after the shooting. The defense argued that he has no criminal history and said he’s lived in Houston for the past six years.

In Friday afternoon, he remains behind bars on a $500,000 bond.

Marzouk wore an orange shirt and appeared late Thursday night.

“Sir, you’re here for the first-degree felony of murder,” the magistrate said.

Marzouk was seen on surveillance video pulling up to Jimmy Arevalo as he was pressure washing kitchen equipment outside the OMG Seafood restaurant early Wednesday morning.

“The witness stated that you arrived at the location and complained to the complainant about the noise from the pressure washing. The witness stated that you exited your motor vehicle, discharged the firearm into the air, pushed the complainant, and then shot the complainant,” the judge said.

Surveillance video captured the entire shooting and showed Marzouk leaving the scene in a gray Toyota Tundra. The magistrate also revealed what happened after the murder.

“You then tried selling your property to other individuals including tools and motor vehicles,” she said.

Arevalo’s family says he was just doing his job and can’t understand how something as simple as noise turned deadly. His brother, Anthony Arevalo, spoke with us before an arrest was made.

“So, the motive was really the noise. The noise of the pressure washer. Probably the guy didn’t do it. Probably was asleep or something and it bothered him. So, because nothing that my brother does doesn’t have enemies. We don’t know anybody in that area. And for this guy to do this over a noise, over a noise of a pressure washer. My brother, we could have told him and just give him 20 minutes. We could have talked to him,” Anthony said.

Anthony described his younger brother as hardworking and kind.

“He was just working, we just work and mind our own business trying to make a living. My brother doesn’t bother no body; he’s a humble person. He goes by the book everything,” he said.

And he says the loss has left their family heartbroken.

“Everybody knew him because he was such an outgoing guy. He would never try to get into no fights, no arguing with somebody. He would try to talk it out, let them know away. He was a wonderful, wonderful person, and he didn’t deserve this,” he said.

The magistrate also ordered Marzouk to surrender his passport, stay away from weapons and drugs, and wear a GPS monitor if released on bond.

Marzouk was set to appear before a judge on Friday, but the case was reset to Monday.
