Authorities identified Smith through video surveillance footage near 1001 Preston Street.

According to court records, Smith admitted to painting the building’s north, west and south sides to “mark territory for gang purposes.”

He did not specify the gang and is not a documented gang member.

Constable deputies found Smith at a nearby METRO rail station and arrested him on charges of criminal mischief and trespassing.

At the time of the incident, Smith was already out on bond for three separate criminal cases: unauthorized use of a motor vehicle on May 5 and May 20, and assault bodily injury on May 27. The assault charge stems from an alleged beating of another inmate while Smith was in custody at the Harris County Jail.
