Whataburger sued by Harris County man after onion in meal causes allergic reaction

A Harris County man has filed a lawsuit against Whataburger, claiming that a mishap at one of the chain’s restaurants led to an allergic reaction.

According to court documents, Demery Ardell Wilson says he asked for no onions on his meal but was served them anyway, leading to a severe allergic reaction that required medical attention.

According to NBC DFW, the lawsuit was filed in Texas’ 269th Judicial District Court of Harris County on April 25. It accuses Whataburger of negligence, stating the restaurant “failed to act in accordance with the appropriate standard of care,” causing Wilson to “suffer personal injuries.”

The incident reportedly happened on July 24, 2024, when Wilson stopped at a Whataburger and ate a meal that contained onions despite his request to leave them off.

Wilson is seeking more than $250,000 but less than $1 million in damages. The lawsuit does not specify which Whataburger location was involved.

NBC DFW also reports this isn’t Wilson’s first lawsuit against a fast-food chain. Last May, he and his attorney filed a lawsuit against Sonic Drive-In, which was dismissed a month later.
